Why do I need to provide safety checks for my rental property?

The Residential Tenancies Regulations 2021 (RTR) came into force on 29 March 2021.

Under the new laws rental providers (previously referred to as landlords) have certain responsibilities for gas and electrical safety.

Rental provider must undertake gas and electrical safety checks every two years, and smoke alarm safety check yearly.

Additionally, rental providers must keep, and be able to produce, records of gas, electrical and smoke alarm safety checks conducted at the property.

Is NCG a qualified safety check service provider?

Yes, NCG is qualified and licenced to provide the safety check services.

NCG will provide the necessary reports after the safety check is conducted.

If the safety check shows repairs or replacement are needed to make the property safe, NCG is qualified and able to do the repair and replacement of equipment work. NCG will provide quote for your consideration before any work is done.

What is required for the gas safety check?

The rental provider (landlord) must ensure a gas safety check of all gas installations and fittings on the premises is conducted every two years by a licensed or registered gasfitter who is endorsed in the specialised class of Type A gas appliances servicing work.

If requested, the rental provider must also provide the renter with the date of the most recent safety check, in writing.

If a gas safety check has not been conducted within the last two years at the time the renter occupies the premises, the rental provider must arrange a gas safety check as soon as practicable.

What is required for the electrical safety check?

Rental provider (landlord) must ensure an electrical safety check of all electrical installations and fittings in the premises is conducted every two years by a licensed electrician.

If requested, they must also provide the renter with the date of the most recent safety check, in writing.

If an electrical safety check has not been conducted within the last two years at the time the renter occupies the premises, the rental provider must arrange an electrical safety check as soon as practicable.

If the safety check shows electrical repairs are needed to make the property safe, the rental provider can engage NCG to do the repair work.

What is required for the smoke alarm safety check?

Rental provider (landlord) must ensure smoke alarms:

  • are correctly installed and in working order
  • are tested according to the manufacturer’s instructions at least once every 12 months
  • have their batteries replaced as required
  • are repaired or replaced as an URGENT repair.

Renters must:

  • notify the rental provider in writing as soon a possible after becoming aware that a smoke alarm is not in working order.

On or before the start of a rental agreement, a rental provider must give a renter written information on how:

  • each smoke alarm works and how to test them
  • the renter must:
    • not tamper with any smoke alarm
    • report a smoke alarm that is not working.

If the safety check shows repairs are needed to make the property safe, the rental provider can engage NCG to do the urgent repair work.

What kind of safety check report should I be expecting?

GAS:

A record of a gas safety check can be either of the following:

  • a document OR checklist

If further gas work must be carried out after the check, a rental provider must also keep the compliance certificate or tax invoice relating to that work.

ELECTRICAL:

A record of an electrical safety check may be any of the following:

  • a document or checklist, OR
  • an Electrical Installation audit report

(If the safety check shows gas or electrical repairs are needed to make the property safe, the rental provider can engage NCG to do the repair work.)
